Terms of Service

These terms govern your use of Availyx at availyx.com (the "Service"). By creating an account, connecting a calendar, or booking time through an Availyx page, you agree to them. If you do not agree, please do not use the Service.

1. The Service

Availyx lets a host publish booking pages backed by their Google Calendar so that guests can reserve available times. Availyx is currently in early access: features may change, and the Service may be modified, suspended or discontinued at any time. We will give reasonable notice of material changes where we can.

2. Accounts

  • You must sign in with a Google account you control and be at least 16 years old.
  • You are responsible for activity under your account and for keeping your Google account secure.
  • One person per account. Team, shared and organizational accounts are not offered at this time.
  • Your public username must not impersonate another person or organization or mislead guests about who they are booking with. We may reclaim usernames that do.

3. Calendar access

By connecting Google Calendar you authorize Availyx to read free/busy information from the calendars you select and to create, update and delete the events that Availyx schedules on the calendar you choose. You can revoke this at any time. How we handle calendar data is described in our Privacy Policy.

4. Acceptable use

You agree not to:

  • Use the Service to send unsolicited invitations, spam, or harassing content.
  • Collect guest information unlawfully or use it for purposes guests would not reasonably expect.
  • Attempt to access other users' data, probe or disrupt the Service, or circumvent rate limits or security measures.
  • Use automated means to create bookings or scrape booking pages at scale.
  • Use the Service for anything unlawful or in breach of Google's terms for the Calendar API.

5. Guests

Guests do not need an Availyx account. By booking, you confirm the details you enter are accurate and agree that they will be shared with the host and included in a calendar invitation. Guests can cancel or reschedule using the link on their confirmation page or in the invitation. Hosts control their own availability and may cancel or reschedule bookings.

6. Your content

You keep ownership of the names, descriptions and messages you enter. You grant Availyx a license to store, display and transmit that content as needed to run the Service (for example, showing an event description on a booking page or writing it to a calendar event). You are responsible for having the rights to anything you submit.

7. Fees

The Service is free during early access. If paid plans are introduced, pricing and terms will be published in advance and will not apply to you until you opt in.

8. Termination

You can delete your account at any time from Settings. We may suspend or terminate accounts that breach these terms, create risk for other users, or have been inactive for an extended period. Upon termination your data is deleted as described in the Privacy Policy; calendar events already created remain on Google Calendar.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Availability calculations depend on data from Google and on the settings hosts configure; we do not guarantee that a booking will never conflict with another commitment, that invitations will be delivered, or that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Availyx and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, missed meetings, or loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or USD 50.

11. Indemnity

You agree to indemnify Availyx against claims arising from your content, your use of the Service in breach of these terms, or your violation of any law or third-party right.

12. Changes to these terms

We may revise these terms from time to time. The date at the top reflects the latest version. Continued use of the Service after changes take effect means you accept the revised terms. Material changes will be announced on the site.

13. Governing law

These terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located there, and you consent to their jurisdiction.
